1. The agreement

These Terms & Conditions govern your use of the Dinetous platform, its dashboards, QR menus, AR previews, public directory and related services (the "Service"), operated by Dinetous. By creating an account, subscribing, or using any part of the Service, you agree to these terms and to our Privacy Policy and Cancellation & Refund Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old and able to enter a binding contract. If you accept these terms for a business, you confirm you are authorised to bind that business, and "you" refers to it.

3. Accounts and security

• You must give accurate registration details and keep them current.
• You are responsible for everything done under your account, including by your staff, and for keeping passwords confidential.
• Staff and waiter accounts you create are your responsibility to grant and revoke.
• Tell us immediately at support@dinetous.com if you suspect unauthorised access.

4. Subscriptions, fees and billing

• Plans and prices are published on our Pricing page. All prices are in Indian Rupees and inclusive of all applicable taxes.
• Subscription payments are non-refundable once made, as set out in the Cancellation & Refund Policy.
• At signup you pay for your first subscription period in full. There is no setup fee and no separate verification charge, and your account is created once that payment succeeds.
• Subscriptions do not renew automatically and no card is stored or debited on your behalf. Each new period is paid for from your dashboard, and access ends when a period you have paid for runs out.
• Upgrades take effect immediately and are charged pro rata. Downgrades take effect at your next renewal.
• We may change prices with at least 30 days' notice by email. A change applies from your next renewal, which you are free not to take.
• If a payment does not complete, no period is added and the account stays as it was until a payment succeeds.
• Payments are processed by Razorpay. Dinetous does not receive or store card details.

5. Acceptable use

You agree not to:

• use the Service for anything unlawful, or to sell items you are not licensed to sell;
• upload content that is false, misleading, obscene, infringing, or that misrepresents another business;
• list a restaurant you do not own or are not authorised to represent;
• attempt to access another restaurant's data, probe or disrupt the platform, or bypass any access control;
• scrape, resell, sublicense or white-label the Service without our written permission;
• upload malware, or place excessive automated load on the platform.

6. Your content

Your menu, prices, descriptions, photos, logos and 3D models remain yours. You grant Dinetous a non-exclusive, worldwide, royalty-free licence to host, reproduce, adapt and display that content solely to operate and promote the Service — including on your public directory profile, if you have chosen to be listed.

You are responsible for the accuracy of what you publish: prices, taxes, allergen and ingredient information, availability and opening hours. Where we generate 3D models or menu copy for you with AI, they are approximations for presentation; you must review them before publishing, and the plated dish may differ.

7. Diners, orders and payments between you and your guests

Dinetous provides the software. When a diner places an order through a Dinetous menu, the contract for that food is between the diner and the restaurant. The restaurant alone is responsible for preparing, pricing, taxing, fulfilling and — where applicable — refunding that order, and for the accuracy of the menu it publishes. Dinetous is not a party to it and does not sell food.

Diners agree to use the ordering interface honestly and not to place fraudulent or abusive orders.

8. Our intellectual property

The Service, including its software, design, AI models, documentation and the Dinetous name and logo, belongs to us and our licensors. These terms grant you a limited, non-transferable, revocable right to use the Service during your subscription. No other rights are granted.

If you send us feedback or suggestions, we may use them without obligation or payment to you.

9. Third-party services

The Service relies on third parties including payment, hosting, email and AI providers. Their availability is outside our control, and their own terms apply to the parts they operate.

10. Availability and support

We work to keep the Service available but do not guarantee uninterrupted operation. Planned maintenance is announced in advance where practical. Support channels and response targets are described on the Contact page and vary by plan.

11. Suspension and termination

• You may stop at any time by not renewing, as set out in the Cancellation & Refund Policy. Amounts already paid are not refunded.
• We may suspend or terminate an account that breaches these terms, is used unlawfully, or has unpaid fees — with notice where reasonably possible, and immediately where the breach is serious.
• On termination your right to use the Service ends. You may export your data before the account closes; see the Privacy Policy for how long we retain it afterwards.

12. Disclaimers

The Service is provided "as is" and "as available". To the extent permitted by law we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. AI recommendations are informational — the commercial decisions you take on the back of them, including pricing and menu changes, are yours.

13. Limitation of liability

To the maximum extent permitted by law, Dinetous is not liable for indirect, incidental, special or consequential loss, or for lost profits, lost revenue, lost goodwill or lost data. Our total aggregate liability arising out of or relating to the Service is limited to the subscription fees you actually paid us in the three months before the event giving rise to the claim.

Nothing here excludes liability that cannot be excluded under applicable law.

14. Indemnity

You agree to indemnify Dinetous against claims, damages and reasonable legal costs arising from your content, your use of the Service, your breach of these terms, or a dispute between you and a diner.

15. Changes to these terms

We may update these terms. The "last updated" date reflects the current version, and material changes are notified by email or in your dashboard before they take effect. Continuing to use the Service after that means you accept them.

16. Governing law and disputes

These terms are governed by the laws of India. The courts at Bikaner, Rajasthan have exclusive jurisdiction over any dispute. Before starting proceedings, please write to us — most issues are resolved in a single email.
